Come and Take It Radio 7/26/09

Good evening! Tonight we began the show discussing the ridiculous hoopla surrounding the Obama "cops reacted stupidly" comment regarding the arrest of Harvard Professor Gates. The question was literally the last question received during the 2 hour press conference regarding the healthcare platform the President is trying to push through Congress and the ONLY thing the media is talking about now.

We then touch on the re-airing of the CBR 60 Minutes special "Gun Sales: Will The "Loophole" Close?" which you can find more about that here -

We then go on to discuss the recent actions by our Governor, Rick Perry. In an article written by the Dallas Star Telegram, Perry raises possibility of states' rights showdown with White House over healthcare. Evidently Perry is trying to attract the attention of the 70,000+ Texans that voted for Dr.Ron Paul to be the Republican candidate for the 2008 US Presidential Election. We then go into the most important topic tonight which is the US Senate to consider Right to Carry Reciprocity Amendment early next week, possibly Monday...According to Gun Owners of America,Senators John Thune and David Vitter are the sponsors of S. 845 -- a bill that will establish concealed carry reciprocity amongst the several states.Senators Thune and Vitter offered the bill as an amendment (#1618) to the Department of Defense authorization bill (H.R. 2647).HR 2647 can be found in its entirety here -

This provision will use the constitutional authority allowing Congress to enforce "full faith and credit" across the country, so that each state respects the "public acts, records, and judicial proceedings" of every other state (Article IV).The benefit of the Thune/Vitter legislation is that -- unlike other, competing measures -- it would protect the right of any U.S. citizen to carry out of state (regardless of whether he possesses a permit), as long as he is authorized to carry in his home state. This is important because of states like Vermont and Alaska, where residents can carry concealed without prior approval or permission from the state... in other words, without a permit!

We then go into CNS News article, Health Care Bill Will Fund State Vaccine Teams to Conduct ‘Interventions’ in Private Homes, found here -

According to the article, the committee’s official summary of the bill says: “Authorizes a demonstration program to improve immunization coverage. Under this program, CDC will provide grants to states to improve immunization coverage of children, adolescents, and adults through the use of evidence-based interventions. States may use funds to implement interventions that are recommended by the Community Preventive Services Task Force, such as reminders or recalls for patients or providers, or home visits.”

We end the show with good news, Texas Attorney Greg Abbott has filed a brief with the US Supreme Court - along with 32 other states, to defends Americans’ right to keep and bear arms.According to the release,

Texas Attorney General Greg Abbott today filed a brief with the U.S. Supreme Court that defends Americans’ right to keep and bear arms. The amicus brief, which was filed on behalf of 33 state attorneys general, supports a legal challenge by Otis McDonald, a community activist who lives in a high-crime Chicago neighborhood. McDonald’s work to improve his neighborhood has subjected him to violent threats from drug dealers, but city ordinances prohibit him from obtaining a handgun to protect himself. The state attorneys general argue that cities cannot simply ignore the Second Amendment of the U.S. Constitution and impose a blanket ban on handguns.

“Last year, the Supreme Court of the United States struck down the District of Columbia’s handgun ban and held that the Second Amendment protects individual Americans’ right to keep and bear arms,” Attorney General Abbott said. “The brief filed today urges the nation’s highest court to hear community activist Otis McDonald’s challenge to an ordinance that prohibits him from possessing a handgun to protect himself from the criminals he has worked to eradicate from his high-crime neighborhood. Today’s amicus brief reflects an effort by more than thirty attorneys general to defend law-abiding Americans’ constitutionally protected right to keep and bear arms.”

The states’ amicus brief says: “The right to keep and bear arms under the Second Amendment is not just a ‘fundamental’ liberty interest. In the Anglo-American tradition, it is among the most fundamental of rights because it is essential to securing all our other liberties. The Founders well understood that, without the protections afforded by the Second Amendment, all of the other rights and privileges ordinarily enjoyed by Americans would be vulnerable to governmental acts of oppression.”

According to the states’ amicus brief, the Second Amendment of the U.S. Constitution applies to states under the Fourteenth Amendment, and the right to keep and bear arms is a right that states have long recognized. In fact, 44 state constitutions protect their residents’ right to bear arms. The brief adds: “The submission of this amicus brief provides further evidence of the States’ understanding of the fundamental importance of the arms-bearing right guaranteed by the Second Amendment.”

“Just as local governments cannot constitutionally act as ‘laboratories’ for initiatives to abrogate their citizens’ right to free speech or their freedom from unreasonable searches and seizures, nor can they nullify the fundamental right to keep and bear arms secured by the Second Amendment,” the amicus brief states.

The states’ amicus brief acknowledges that some firearms regulations are permissible, including in circumstances where they are necessary to prevent violent felons from owning guns.The states ask the U.S. Supreme Court to hear both the McDonald case and National Rifle Association of America Inc., et al v. City of Chicago, Ill., et al.

The states that joined Texas in the amicus brief are: Alabama, Alaska, Arkansas, Colorado, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Maine, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, New Hampshire, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Utah, Virginia, Washington, West Virginia and Wyoming.

Today we started the show with the unfortunate news that our friend and former DEA Veteran Celerino (Cele) Castillo was ordered to report to jail July 30, 2009. In the second hour we switched topics to HR 2454 and how the Senate is expected to delay the climate bill until September

Happy Independence Day everyone, thanks for listening! We began the show discussing the current "Tea Party Movement" and an article by The Washington Independent stating that the movement is losing steam. In reality, FOX and the MSM destroyed the tea party movement by turning it into a big ANTI-Obama, big GOP agenda which is not what the tea party movement was supposed to be about. In the 2nd hour we discuss a few bills that we need you to call your US Senators on now that they are back to work.

The first act is the Pass Act S.1261, according to an article on,

The senate committee on Homeland Security and Governmental Affairs will be considering the legislation very soon.

The PASS Act does not repeal the Real ID Act. It does repeal provisions of the Real ID Act; those provisions that are included in Title II of the Real ID Act 2005. The Real ID Act is still intact and is federal law.

The PASS Act contains many of the most egregious aspects of the Real ID Act; including the requirement for a digital facial image/photograph that will be mandated to be internationally facial recognition compatible.

The second bill is HR 2454 or the 'American Clean Energy and Security Act of 2009'. Here is a summary from on the new "Cap-and-Trade" bill that passed the House 212-219 just less than 2 weeks ago.

"This is the Waxman-Markley comprehensive energy bill, known for short as "ACES," that includes a cap-and-trade global warming reduction plan designed to reduce economy-wide greenhouse gas emissions 17 percent by 2020. Other provisions include new renewable requirements for utilities, studies and incentives regarding new carbon capture and sequestration technologies, energy efficiency incentives for homes and buildings, and grants for green jobs, among other things."
